James Caan (a shallow and self-important television personality interviewed on the Today programme this morning) should be aware that he, and other employers that employ family members, are potentially breaking the law.
Employment legislation says that unless the employment process is transparent it is automatically regarded as discriminatory if an unsuccessful applicant brings a complaint of discrimination (automatically note).
The complainant does not have to prove discrimination. They merely have to bring a complaint and the employer has to prove they have not discriminated. In the case of employing family members the suggestion of bias is going to be so strong that proving discrimination has not taken place will be almost impossible.
For the record, there is nothing more unpleasant than working with people who are children of senior staff (or indeed who are sleeping with senior staff).
